Terms of Use

Under the commission of the Tokyo Metropolitan Government, the Tokyo Convention & Visitors Bureau (hereinafter referred to as the "Bureau") provides a tourist information AI chatbot (beta version) (hereinafter referred to as the "Service"), which uses generative AI to offer real-time tourist information through tools like chat services to both domestic and international travelers, from any tourist destination or other location of their choosing.

The Service refers to a multilingual chatbot service. The chatbot of the Service is designed to simulate human interactions, providing responses and engaging in conversations with the user (hereinafter referred to individually as the "User" and collectively as "Users"). The Service facilitates smooth multilingual communication by translating to and from the language of the User.

The terms and conditions of use of the Service (hereinafter referred to as "these Terms") outline the matters that Users must adhere to when using the Service. By commencing use of the Service, the User is deemed to have agreed to these Terms as well as the Privacy Policy. These Terms apply to all Users, and any User who does not agree to the Terms cannot use the Service.

1. Changes, suspension of use, etc. of the Service

  • The Bureau reserves the right to change these Terms and the Privacy Policy at its discretion, and the User shall be deemed to have accepted these changes.
  • The Bureau may make necessary changes to the system or content related to the provision and operation of the Service without prior notice to the User if it deems such changes necessary.
  • The Bureau shall not be liable for any damages incurred by the User in the case of suspension or termination of the Service due to reasons such as system maintenance.

2. Use environment

The User shall be responsible for arranging the environment for use of the Service, such as securing the necessary hardware, software, and Internet connection, as well as for ensuring security at his/her own cost.

3. User obligations

General

The User agrees to the privacy policies of OpenAI, L.L.C. and OpenAI OpCo, LLC.

The User shall be responsible for verifying the accuracy and reliability of the information obtained through the Service.

The User shall not enter any personal information, sensitive personal information or confidential information, including but not limited to those described below. If the User submits such information, the User shall be deemed to permit the Bureau to acquire and use the information.

  • Race, religious beliefs, social status, medical history, criminal history, or facts related to being a victim of crime
  • Information that includes matters related to personal privacy or highly sensitive personal details
  • Information that includes personal identifiable information, such as name and phone number

The User must not enter the following:

  • Inappropriate expressions, defamatory, or discriminatory language
  • Information that may be perceived as threatening or intimidating to others
  • Information that encourages or incites violence, cruel acts, or illegal activities
  • Information that violates laws and regulations or public order and morals
  • Any information deemed inappropriate by the Bureau

While the provision of personal information by the User is not anticipated within the Service, if personal information is provided, the Bureau may obtain and use it under the scope below.

  • Provision to third parties (including OpenAI, L.L.C. and OpenAI OpCo, LLC) for the use of the Service
  • Maintenance and management of the Service
  • Provision of the Service and the planning, research, and development of new services
  • Responding to inquiries from the User and verifying User identity

Compliance with laws and regulations

The User agrees to comply with all applicable laws when using the Service.

Aggregated anonymous data

Notwithstanding the provisions set forth under these Terms, the User agrees that the Bureau may collect and aggregate technical and other data related to the activities of Users within the Service, provided that such data cannot identify any User (hereinafter referred to as "Anonymized Data"). The Bureau may use the Anonymized Data for the analysis, improvement, support, and operation of the Service, as well as for any business purposes (including generating industry benchmarks or best practice guidelines, recommendations, or similar reports for distribution to and use by Users and other parties). In addition, this clause does not grant the Bureau, as the aggregator of Anonymized Data, the right to identify any User.

Prohibition of use outside of the intended purposes

The User may only access and use the Service for lawful and permissible purposes. They may not use the Service for the purposes described below. In addition, the User shall not engage in use of the Service through other companies.

  • Commercial use
  • Illegal acts or activities related to crime
  • Infringing, abusing, or misappropriating of the privacy, reputation, goodwill, image rights, intellectual property, or proprietary rights of a third party
  • Activities that promote or incite indecency, instigation, defamation, intimidation, harassment, hatred, or racial or ethnic discrimination, as well as inappropriate acts including facilitating illegal, discriminatory, and violent criminal activities
  • Illegal or unacceptable communication, such as sending bulk messages, automated messages, and making automated calls
  • Acts offensive to public order and morals
  • Other activities deemed inappropriate by the Bureau

Prohibited matters

The User is prohibited from accessing, using, copying, adapting, modifying, creating derivative works, distributing, licensing, sublicensing, transferring, displaying, performing, or otherwise utilizing services provided by the Bureau through any unauthorized or unapproved methods, including by direct or automated means and by any of the following means, which may damage the Bureau, Service, system, other Users of the Service or other third parties.

  • Reverse engineering, modification, creation of derivative works, decompilation, code extraction
  • Sending, storage, or infection of the Service with viruses or malicious code
  • Unauthorized access to the Service or the system, and such attempts
  • Interfering with the integrity or performance of the Service
  • Collection of information from Users of the Service or third parties through fraudulent or automated methods
  • Sale, resale, rental of, or charging for the Service

4. Ownership

Technology of the Service

These Terms concern the access and use of the Service. Unless expressly stated in these Terms, no rights to the underlying technology of the Service are granted to the User. The User also acknowledges that he/she has no right to obtain any copy of the Service.

5. Feedback

The User may submit feedback to the Service at any time. The Bureau shall be free to use or utilize the feedback for any purpose in connection with the Service. The Bureau is under no obligation to respond to such feedback. The User hereby grants the Service a perpetual, irrevocable, royalty-free, worldwide license to use and/or incorporate feedback into the Service at any time at the sole discretion of the Service, if the feedback becomes necessary for any reason.

6. Guarantee of provided information

The Bureau does not guarantee the accuracy, completeness, fitness for purpose, usefulness, legality, immediacy, or non-infringement of third party rights of the information generated by the Service. The Bureau also does not guarantee the consistency of information in responses provided by the Service to inquiries from Users, nor does it guarantee the accuracy of information that may be obtained through the Service. The Bureau does not guarantee that the Service will meet the expectations of Users.

7. Handling of personal information

The Bureau will appropriately handle the personal information of Users in accordance with its Privacy Policy.

8. Disclaimers

The Bureau shall not be liable for any direct or indirect losses incurred as a result of the use of the information or content contained in the Service by the User.

9. Governing law and jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Japan. Any dispute, action, claim, or cause of action arising out of or relating to these Terms or the Service, irrespective of the choice or conflict of law provisions of in any jurisdiction, shall be subject to resolution at the Tokyo District Court of Japan, which shall have exclusive jurisdiction as the court of first instance.


Privacy Policy

The tourist information AI Chatbot (beta version) (hereinafter referred to as the "Service") collects information from users of the Service (hereinafter referred to individually as the "User" and collectively as "Users") as necessary for smooth service operations (answering questions related to tourism through text). The collection, use, and management of the information will be conducted appropriately in accordance with the “Tokyo Convention & Visitors Bureau Personal Information Handling Guidelines” as described below, and we will strive to create a service that can be used with peace of mind by everyone.

1. Personal information to be collected

The Service does not collect personal information. The User shall be responsible for not entering personal information, regardless of its sensitivity, into the Service.

2. Purpose of use of personal information

Although the Bureau does not anticipate the provision of personal information by the User in the Service, if personal information is provided, it will be used for the purposes specified below. Any use beyond these purposes or provision to third parties shall not be carried out except in cases stipulated by laws and regulations. Aggregated statistical data on User attributes and such information that do not contain any personal information may be published.

  • Provision of services, including sharing information with third parties such as OpenAI, L.L.C. and OpenAI OpCo, LLC
  • Maintenance and management of the Service
  • Planning, research, and development of new services
  • Registration and identity verification for the Service
  • Sending inquiries, responses, and identity verification requests to the User

3. Provision of personal information to third parties

Shared use

The Bureau may share personal information with the Tokyo Metropolitan Government as its business contractor within the scope necessary for achieving the purposes specified above.

Provision to contractors

The Bureau may provide personal information to contractors (including developers, operators, and AI service providers of the Service) within the scope necessary for achieving the purposes specified above. In such cases, the Bureau will appropriately supervise information management at the contractor.

The Bureau may provide personal information to third parties with prior consent obtained through the Terms of Use of the Service.

Others

In cases where it is necessary for the protection of human life, body, or property, and it is difficult to obtain the User's consent, the Bureau may provide personal information to third parties in compliance with the Personal Information Protection Act. Even in such cases, the provision will be limited to the necessary scope, and efforts will be made to protect the privacy rights of the User.

Cookies, etc.

The Bureau may use cookies and similar technologies to obtain various information (such as IP address, device ID, location information, access log, and browsing history). For details, please refer to the Cookie Policy. Although some of this information may not fall under personal information, this Policy shall apply to the information that falls under personal information.

Security measures

The Bureau shall take necessary and appropriate security measures to prevent the leakage, loss, or damage of personal data. The Bureau shall also appropriately supervise employees and contractors (including subcontractors) who handle personal data.

2. Definition of Cookies, etc.
